About the Event

Our 2023 Annual Florida Summit will kick off in December at the Hyatt Regency Clearwater Beach Resort and Spa. It will include our famous year-end regulatory overview, covering how the world of telemarketing regulations developed in 2023 and what to expect in 2024.

2023 has further fragmented the status of telemarketing regulations, with countervailing and contradictory trends abounds at the state and federal level. On the one hand, the Florida legislature passed amendments to the FTSA that severely reduce the litigation risks of the mini-TCPA that has been so costly to callers. On the other hand, the first class actions are being filed in Oklahoma under the OTSA, that state's carbon copy of the more dangerous version of the Florida mini-TCPA. And the FCC's rulemaking relating to third party leads threatens to destroy the entire leads industry. Then there are other state laws, federal rulemaking, and the Biden administration's quixotic attempts to fully staff the FCC with a Democratic majority. There's a lot going on!

It is challenging to keep current with the rules, thanks to all the new laws, precedent-setting court cases, and declaratory rulings. Eric Troutman is the Czar of TCPAWorld and one of the country’s prominent class action defense lawyers. He is nationally recognized in Telephone Consumer Protection Act (TCPA) litigation and compliance. He has served as lead defense counsel in more than 300 national TCPA class actions and has litigated over a thousand individual TCPA cases in his role as national strategic litigation counsel for call center operators, lead providers, retailers, banks and finance companies. He frequently advocates before the FCC for TCPA sanity and helps industry participants build TCPA-compliant processes, policies and systems.

Michele Shuster is a founding partner of Mac Murray & Shuster LLP and former Chief of the Ohio Attorney General’s Consumer Protection Section. Bringing more than two decades of experience in the consumer protection arena, she advises highly regulated businesses on a wide range of privacy, advertising, and other consumer protection matters. Michele regularly represents clients in matters before the FCC, FTC, and state attorneys general, conducts regulatory compliance audits and provides defense in government enforcement actions.

One of the best known names in the marketing legal world -- Puja J. Amin -- has vast experience defending and counseling businesses on consumer protection laws including the Telephone Consumer Protection Act (“TCPA”) and a host of privacy-related statutes. She has provided legal oversight on an enterprise basis to major direct-to-consumer brands and defended some of the largest companies in the nation in major federal court litigation--earning her the title of "Queenie" of the TCPAWorld. Peggy Daley

Vice President at Charles River Associates

Peggy Daley has over 25 years of experience in investigations, data analytics, dispute resolution, and regulatory compliance. She has conducted hundreds of trade secret theft, fraud, and hacking investigations on behalf of Boards of Directors and outside counsel. Ms. Daley has testified at regulatory and sanctions hearings and also serves as an expert witness in matters relating to fraud, data privacy, data analytics, TCPA, and data security. Ms. Daley is a frequent lecturer on topics of data privacy, data security, fraud, and intelligence gathering.

Aaron Weiss

Partner at Carlton Fields

Aaron Weiss is recognized for his national litigation practice focused on telecommunications law, class actions and consumer claims. He has extensive experience in litigating matters under the Telephone Consumer Protection Act, of note is his precedent-setting Florida TCPA decisions. In addition to TCPA Aaron frequently litigates class action cases under a broad variety of consumer protection statutes, including the Fair Credit Reporting Act (FCRA); the Fair and Accurate Credit Transactions Act (FACTA); the Fair Debt Collection Practices Act (FDCPA); and the Florida Consumer Collection Practices Act (FCCPA).

Alexandra Krasovec

Partner at Manatt, Phelps & Phillips, LLP

Alexandra Krasovec is a TCPA compliance and class action defense partner in Manatt’s Los Angeles office. She helps clients navigate the TCPA and other state telemarketing laws by providing tailored compliance advice, aiding in due diligence efforts, and defending class actions. Alexandra’s clients include retailers, marketing agencies, technology companies, health care providers and health plans, insurance companies, lead generators, and financial institutions. She often speaks and writes on pressing TCPA updates and other federal and state consumer protection statutes.

Elaine (Lainey) Smith is an Associate Principal within the Forensic Services practice at Charles River Associates. She specializes in gathering, mapping, and interpreting Big Data while developing analyses at the behest of Fortune 500 corporations, financial institutions, major law firms, and regulatory bodies. Ms. Smith’s focus is on investigations and analyses related to consumer class actions in the TCPA, Biometric Information Privacy Act, Fair Credit Reporting Act, and related data privacy spaces. Lainey provides expert testimony in matters alleging violations of the TCPA and has specialized in TCPA-related data analytics for over 7 years.
